OAKMONT COMMUNITY SALES ASSOCIATION 

BOARD MEETING MINUTES

NOVEMBER 9, 2023 

 

The meeting was called to order at 5:46 pm by President Haupt – following the OCIA meeting.

Present: Board Members Gary Haupt, Megan McGuire, Jeff Wilhoit, Eric Franklin and Ronnie Smith were in attendance. Debra Clark, in attendance for vacationing Polly Rannells, and Donnie Sherwood were present. Four HOA members were in attendance in the audience

Absent:  None.

Amend/Approve Agenda: The agenda for the meeting was presented for review

  • Motion: Megan McGuire moved and Jeff Wilhoit seconded to approve the agenda as presented. All Board members voted in favor of the motion. Motion carried and agenda approved.

Minutes of Regular October 12, 2023 meeting: The minutes of the October 12, 2023 regular meeting were presented for review

  • Motion: Megan McGuire moved to waive reading of the minutes at the meeting and approve the minutes as presented and Eric Franklin seconded the motion. All Board members voted in favor of the motion. Motion carried and minutes approved. 

Treasurer Report: Treasurer Jeff Wilhoit gave the OCSA Treasurer’s report as follows:

  • As of 10/31/2023, the Checking account balance was $242,945.40; Heim Young account balance was not available – will be reported at the December meeting. See the OCSA Treasurer’s Report herein attached and incorporated by reference to these minutes

Administrative Report

  • Lot Sales Report: – Debra Clark stated there were two lot sales in October.
  • Taney County Fire District Survey of Tract 27 portion and sale status: Pending final survey.

Old Business:

Lakewood Delapidated House Complaint:  Pending review and site visit.

Give Back Lot Requests:  In the last month, the Association has continued to receive inquiries as to owners/members giving their lots back to the Association in exchange for the amount of delinquent dues owed. Pending review and recommendations.

Cargo Container Complaint:  Pending Letter.

New Business:

Lyle Malcore and Susan Foster:  Malcore and Foster requested pricing of Ozark Paradis Village, Block 61, Lots 12, 13, and 14 on Jones Road – all three lots together. Review by the Board along with a site visit was completed. Gary Haupt stated this area is ready for development and individually, lots could be priced at $8,000+. However, these individual lots are more narrow and should be sold together for proper water and sewer infrastructure.

  • Motion: After review of the contours, location on a paved, County maintained road, and other criteria, Gary Haupt moved and Eric Franklin seconded to price all three lots together at $15,000. All Board members voted in favor of the motion. Motion carried. 

Doug and Lisa Friedrichsen:  Friedrichsen’s have submitted individual offers of $5,000, $5,000 and $2,500 respectively (totaling $12,500) for Ozark Paradise Village, Block 6, Lots 195, 196 and 199 on Shore/Club Drive bordering Tract 25. The Board noted the potentially related agenda item later in this meeting on Tract 25.

  • Motion: Eric Franklin moved and Jeff Wilhoit seconded to table the discussion on these three lots and offers to December to allow for further discussion as these three lots and the interest in Tract 25. All Board members voted in favor of the motion. Motion carried.

Sheldon and Andrea Hunter:  Hunter’s are requesting a price on Lakewood, Block 3, Lot 21 on Cedar Drive. The Board wants to conduct a site visit and requests the Staff to provide any previous Board pricing on this lot before taking action.

  • Motion: Megan McGuire moved and Jeff Wilhoit seconded to table this item to the December meeting pending further information. All Board members voted in favor and the motion carried

Tract 25 offers and interests:  The Board has been made aware over the last couple of months of multiple interests and offers on Tract 25 with 6+ acres still owned by the Association. There had been previous interest in this tract over the years but not until the tract had been surveyed an appraised in the 2020/2021 time frame did the interest increase to offers in the range of the appraisal in addition to an investigation of unauthorized tree cutting and removal in July that resulted in the Board to voice concerns about the access and drainage way protection on the tract. Robert and Valerie Budd made an offer of $15,000 for the 6+ acre tract in conjunction with their proposed remediation plan for the tree and land disturbance in August. This offer was rejected by the board and communicated to the Budd’s on 9-19-23 with no further counter or other action received to date by the Board. Josh and Janet Weaver submitted a written offer of $80,000 on 10-18-2023 for the entire tract and at the meeting voiced commitment to pay HOA assessment(s) as deemed appropriate by the Board. Doug and Lisa Friedrichsen submitted a written offer of $80,000 on 10-20-2023 for the entire tract. Per the Board’s policy on sales and negotiation on open lots/tracts, the Weaver’s are the first position to negotiate the pricing and conditions. The Board discussed their continuing concerns about the access points, stormwater and drainage issues as it related to the creek that runs through the middle of Tract 25 and drains an entire hillside bordered by lots owned privately and by the Association, roadway maintenance, and how to assess the Tract. The Weavers expressed commitment to work with the Board in evaluating these concerns and the desires of the other interested parties to the extent possible and reasonable.

Adjournment: With no further business to come before the Board, Gary Haupt called for adjournment of this meeting and to proceed to Executive Session

  • Motion: Jeff Wilhoit moved and Eric Franklin seconded to adjourn to Executive Session at 6:45 p.m. All Board members voted in favor and the motion carried

The next regular meeting will be held on December 14, 2023
