BOARD MEETING MINUTES – SPECIAL SESSION
MAY 24, 2023
The meeting was called to order at 4:00 p.m. by President Haupt.
Present: Board Members Gary Haupt, Jeff Farquhar, Megan McGuire, and Eric Franklin were in attendance. Guest Jerany Jackson, GRE, was present.
Absent: Jeff Wilhoit was out of town.
Old Business:
President Haupt called this special session to expedite a response back to Jerany Jackson, GRE, on the Right-of-Way documents for the sight line easement at Devil’s Pool Road for the Highway 86 roadway improvements. The Board was in favor of the donation of the small 515 square foot piece of land on Tract 27 for the improvements and safety of the roadway as beneficial to the Oakmont members, however, the two large display rocks need to be preserved and relocated to two different locations. Jerany Jackson presented the Negotiator’s Report that described the display rock relocations in detail for the responsibility of the contractor to move both Oakmont Community display rocks as requested by the Oakmont Board. Jerany Jackson then reviewed the construction schedule and nature of the construction which will primarily be at night, but to be prepared for 24/7 activity on the site from mid- June to mid-September. She stated that MODOT will post the plans, schedule, and any updates on their website like any other MoDOT project. The Board reviewed the Negotiator’s Report, donation proposal, General Warranty Deed, Highway 86 Improvements for Thunder Ridge Arena Right of Way diagram, and Certified Resolution with the addition of the relocation of the two Oakmont Community display rocks from the construction zone to two different locations.
- Motion: After detailed review of the documents and discussion, Megan McGuire moved and Jeff Farquhar seconded to approve and execute the Certified Resolution as modified, Donation Letter and General Warranty Deed. All Board members voted in favor and the motion carried.
New Business:
President Haupt believed it was important due to the nature of the land disturbance to include this item in the special session. There appears to be an unauthorized entry, removal of trees, topping of trees and land disturbance from the corner of Tract 25 next to Lakeview Court. This tract is still owned by the Association and there has been recent interest in the purchase of this tract. The disturbed area is immediately behind the house at 845 Lakeview Court. The Board discussed the boundary lines and due to the shape of the entrance to Tract 25, the property line is not obvious without marking from the previous survey. If there is unauthorized entry, the value of the land and trees could be determined by a certified landscape appraiser. The Board believes the first step is to notify in writing the landowner(s) and tenants of the issues and have the boundary line marked between 845 Lakeview Court and Tract 25 as soon as possible.
- Motion: Megan McGuire moved and Eric Franklin seconded to hire a surveyor to mark the property line at corner of Tract 25 and end of Lakeview Court and send letter to owners/tenants.
Adjournment: Gary Haupt called for adjournment.
- Motion: Jeff Farquhar moved and Eric Franklin seconded to adjourn at 5:05 p.m. All Board members voted in favor and the motion carried.
The next regular meeting will be held on June 8, 2023.
